Welcome to Omniscient, a service provided by Black Dash Interactive Design Sdn Bhd (the “Company”). By accessing or using Omniscient (the “App”) or the website https://Omniscient.my (the “Site”), you agree to comply with and be bound by the following terms and conditions (“Terms of Use”). If you do not agree with these Terms, please do not use the App or the Site.
1. Acceptance of Terms
By accessing or using Omniscient or the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
2. Changes to Terms
The Company reserves the right to change, vary, or modify any of the information and terms contained herein and on the App or the Site at any time without notice. Any changes will be effective immediately upon posting on the App or the Site. Your continued use of Omniscient after any changes constitutes your acceptance of the new Terms.
3. Intellectual Property
All content on Omniscient and the Site, including but not limited to text, graphics, logos, images, and case studies, is the property of Black Dash Interactive Design Sdn Bhd or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Client Logos: Any logos or trademarks featured on the Site that belong to our clients are the property of their respective owners. Black Dash Interactive Design Sdn Bhd does not claim ownership of these logos and uses them solely for illustrative purposes to showcase our work.
You may not reproduce, distribute, or create derivative works from any content.
4. User Conduct
You agree to use Omniscient and the Site only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use of the App or Site. Prohibited activities include but are not limited to:
- Posting false or misleading information.
- Engaging in any form of harassment or abuse.
- Transmitting viruses or harmful code.
5. User Content
If you submit any content to Omniscient or the Site (e.g., comments or feedback), you grant Black Dash Interactive Design Sdn Bhd a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, publish, and distribute such content in any media.
6. Links to Third-Party Websites
Omniscient or the Site may contain links to third-party websites/portals/gateways. This does not imply the Company’s endorsement of any website/portal/gateway, and the Company is not responsible for the actions, content, information, or data of third-party websites/portals/gateways or any link(s) contained in them. Third-party websites/portals/gateways will likely provide their own terms and conditions of use and privacy policies that may apply to you. Any link(s) to other websites/portals/gateways are provided as a convenience to you and shall not be construed in any way whatsoever as an endorsement or verification of such websites/portals/gateways and shall be accessed at your own risk. Third-party websites/portals/gateways are not under the Company’s control; therefore, the Company shall not be held responsible nor liable for any damage or injury arising therefrom.
7. Indemnity
You shall indemnify and keep Black Dash Interactive Design Sdn Bhd indemnified against all claims, damages, actions, and proceedings made or brought against the Company arising from your use of Omniscient and/or any breach of these Terms by you.
8. Termination or Suspension
The Company reserves the right to bar any individual, company, or group from the use or access to Omniscient or the Site. Termination of access can be executed permanently or temporarily, in part or in whole, at the Company’s discretion, at any time without prior notice or reason. You agree to accept the Company’s decision as final and binding.
9. Feedback
You hereby irrevocably and unconditionally assign to Black Dash Interactive Design Sdn Bhd all rights, titles, and interests in and to any feedback, suggestions, questions, proposals, ideas, inventions, concepts, techniques, and/or know-how that you may give the Company regarding Omniscient or the Site without any right to compensation from the Company.
10. Waiver
No failure on the part of Black Dash Interactive Design Sdn Bhd to exercise any power, right, or remedy under these Terms shall operate as a waiver thereof; nor shall any single or partial exercise of any power, right, or remedy preclude any other further exercise thereof or the exercise of any power, right, or remedy. The remedies provided in these Terms are cumulative and are not exclusive of any remedy provided by law.
11. Severability
If any term, covenant, or condition of these Terms or application thereof to you or Black Dash Interactive Design Sdn Bhd shall be or become invalid or unenforceable, the remaining terms shall not be affected thereby, and each remaining term shall be valid and enforceable to the fullest extent permitted by law.
12. Privacy Notice
You have fully read and understood the privacy notice set out on Omniscient and/or the Site and hereby agree and consent to Black Dash Interactive Design Sdn Bhd using your personal data in accordance with the terms set out in the privacy notice.
13. Governing Law and Jurisdiction
The parties agree that the laws of Malaysia for the time being in force shall govern any disputes pertaining to these Terms; further agreeing to submit to the non-exclusive jurisdiction of the courts in Malaysia.
